1. Overview
Web3 Files Network respects intellectual property rights and responds to notices of alleged copyright infringement
in accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and other applicable laws.
2. Scope of Our Control (Important)
IPFS is a decentralized, peer-to-peer network operated by independent third parties. Because of this architecture,
Web3 Files Network does not control the IPFS network and cannot delete a CID from IPFS globally.
However, we can take action on services and access mechanisms we control. Depending on the circumstances, our response
to a valid DMCA notice may include one or more of the following:
- Disabling access to the content through our website, dashboard, and member tools;
- Removing or disabling references to the CID within a user account (where appropriate);
- Removing content from any indexing, search, or discovery features we operate;
- Stopping any pinning, caching, or gateway delivery services that we operate or provide;
- Suspending or terminating accounts of repeat infringers.
3. How to Submit a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe content accessible through our Services
infringes your copyright, you may submit a notice to our DMCA Agent.
To help us process your request quickly, please include:
- The CID(s) involved (if known);
- Any dashboard folder path or account identifiers (if available);
- The exact URL(s) where the material is accessible through our Services;
- Any screenshots or supporting documentation.
4. Required Information (DMCA §512(c)(3))
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
-
Identification of the allegedly infringing material and information reasonably sufficient to locate it (for example:
CIDs, URLs, and any account/dashboard references).
- Your name, mailing address, telephone number, and email address.
-
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner,
its agent, or the law.
-
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner
or authorized to act on the owner’s behalf.
5. Counter-Notification
If you believe your content was disabled by mistake or misidentification, you may submit a counter-notification.
Your counter-notification should include:
- Your physical or electronic signature.
- Identification of the material disabled and where it appeared before it was disabled.
- A statement under penalty of perjury that you have a good-faith belief the action was a mistake.
- Your name, address, telephone number, and a statement consenting to the jurisdiction of the applicable federal court.
6. Repeat Infringer Policy
In appropriate circumstances, and at our discretion, we may terminate accounts of users who are repeat infringers.
